O-Creation Solutions LLC Terms and Conditions

O-Creation Solutions LLC is a professional full-service travel agency that consists of travel consultants who research, plan, book and manage all aspects of travel between verified suppliers, tour operators, destination management companies and all entities inclusive of all travelers/clients.

Consultation & Trip Management Fee

We provide a complimentary consultation (maximum of 30 minutes) to lead traveler and all parties of interest to prepare a customized itinerary for our clients.

Lead traveler will pay initial trip management fee in advance of deposit in order for details of the trip to be provided. Maximum of three (3) quotes will be provided (up to three resorts, per destination) within 72 hours of receipt of fee.

An invoice for the lead traveler’s trip management fee will be forwarded within 24 hours of consultation.

Full payment of fee is required to retain our professional services to craft an itinerary/plan for a maximum of three (3) quotes. A reservation must be booked within 30 days of the date of the last quote provided or an additional fee may be charged to book beyond that time.

A trip management fee to include but not limited to research, coordination, reservation, (of transportation, air, resort/hotel, transportation, excursions, events and activities), payment and full management for the following:

  • Friends and/or Families trips (10 or more people or contracted of a minimum of 10 rooms)
  • Group trips (10 or more people or contracted of a minimum of 10 rooms)
  • Weddings ((10 or more people or contracted of a minimum of 10 rooms)
  • Complex/Specialized & Customized Itineraries (Disney, Universal Studios, International Trip, Villa Rentals, etc.)

All trip management fees are per person rate (ages 2 and older if reservation includes air; newborn and older for cruise reservation; ages 18 and older for resort only reservations; for excursions and activities reservations only, fee will be accessed based on required age to participate) and will be invoiced to be paid at the time of deposit to confirm reservation.

Trip management fees are non-refundable and non-transferrable.

Validity and Price Guarantee

All prices are based on currency rates of exchange at time of full purchase (when balance is paid in full). *

All itineraries and packages are based on airlines/hotel/cruise/tour policies schedules and operational conditions at time of full purchase.

All prices are subject to change without prior notice due to currency fluctuation, fuel prices and/or unforeseen economic circumstances.

Air and cruise fuel surcharges are included in prices and are subject to change.

In case of human or computer error O-Creation Solutions LLC reserves the right to reinvoice for the correct price or service. Such changes will be submitted to client/guest in writing to inform of error and corrected price.

Deposit/Final Payment Policy

  • All deposits must be submitted with a signed reservation form.
  • Credit/debit cards are accepted method of payments (we discourage the use of gift cards due to the limited protection offered to consumers); cash and checks are not accepted
  • Minimum deposit varies and is based on supplier, hotel and air carrier requirements.
  • Failure to submit payments by the original final payment date may require O-Creation Solutions LLC to negotiate an extension with the supplier that reservation was booked with. If an extension is granted, a $50 extension fee will be added to your final payment. If the extension is denied, the reservation may result in an automatic non-refundable cancellation if final payment is not received.
  • Trip management fees are due at the time of deposit for a reservation.

Installment Payments

  • For all reservations that are not paid in full at time of booking, monthly or bi-monthly installment payments are required.
  • Upon receipt of deposit, monthly or bi-monthly payment installments will be required for the remaining balance.  Installment schedule will be provided and will include amount of payments and due date for monthly payments along with the number of required payments for the schedule.
  • Failure to maintain monthly or bi-monthly payment installment may result in cancellation of reservation unless alternate arrangement is made.
  • Declined payment(s) will not be automatically resubmitted. Traveler will be notified via email or by telephone (text). It is the responsibility of traveler to submit proper payment information.

Agency Cancellations / Refund Policy

  • All required deposits will be refunded, unless stated otherwise at time of consultation and/or deposit.
  • Any required deposit may be refunded and subject to penalties and fees based on supplier refund schedule and may incur a cancellation fee with our agency, which is in addition to supplier fees and assessed per traveler.
  • If a refund is warranted after all fees are applied, payment will be processed and submitted back to the card used for payment. I
  • f multiple cards were used, payment will be issued to the cards on file.
  • All cancelled reservations need to be submitted in writing and may incur a cancellation fee of $50 per person. This fee is in addition to any charges imposed by the supplier. If a refund is due, please expect a wait of 7-10 business days or longer for processing.

Please note we are not responsible for payment issued to any gift or prepaid cards that are lost, discarded or no longer in client’s possession.

We strongly recommend the purchase of travel protection to protect travel investment.

For Group, Hosted, Wedding and Customized and Complex Itineraries/Reservations

All required deposits and payments for group, hosted, weddings, excursions and customized are non-refundable and non-transferrable due to contractual agreements made with our suppliers that doesn’t allow for refunds to be issued.

  • All cancelled reservations need to be submitted in writing and may incur cancellation fee of $50 per person. This fee is additional to any charges imposed by the supplier.
  • The travel consultants of O-Creation Solutions LLC are group travel specialists with a focus of 10 or more travelers. We reserve the right to cancel and/or transfer any reservations after 60 days if the minimum number of travelers are not booked, by notifying the group leader in writing. We will not be responsible for any cancellation fees that are incurred as a result of said cancellation or transfer.

Please note we are not responsible for payment issued to any gift or prepaid cards that are lost, discarded or no longer in client’s possession.

We strongly recommend the purchase of travel protection to protect travel investment.

 

Agency Change Fee Policy

  • All reservations must match the names that appear on your passport. Any changes to a reservation to include a passenger name change will result in a fee of $50 per person and will be required before any changes are made. This fee is additional to any charges imposed by supplier to include rebooking airfare. Each passenger is responsible for verifying their personal information at the time of submitting a reservation form. If a passport is not in possession at time of booking and upon receipt there is a different name or spelling of name, it is the responsibility of the passenger to inform O-Creation Solutions LLC so that a change can be submitted.

O-Creation Solutions LLC is not responsible for incorrect information provided to us by passengers and will not be held liable should denial to board an aircraft, cruise ship, train or granted access to hotel and/or resort due to traveler’s failure to have information corrected.

Fraudulent Activity

  • In the event of credit card fraud or consumer chargebacks, the traveler is still responsible for the full agreed amount (unless a mutual agreement was reached and signed by our agency and client explaining the circumstances and authorizing said agreement); that the agency will seek recovery of full amount in addition to fees and penalties through legal channels.  These fees and penalties will include any and all financial losses incurred by agency due to the chargeback (i.e. loss of commission) in addition to any and all additional expenses incurred by the agency due to the chargeback (court costs, filing fees, certified letters, legal fees , etc.) including the cost for the time needed to research, send emails, make calls in order to provide required documents to the credit card company for the court system and any other agencies, needed to help to recover the funds.  The research rate is billed at one hundred ($100) per hour and logged by a minimum of 30-minute increments per session.

Recovery avenues can involve but is not limited to legal action and/or your account being placed in collections.

Required Travel Documents

  • All documentation requirements for passport, visa, vaccination, or other travel requirements for the destinations of travel is the responsibility of the traveler. The traveler should review requirements well in advance of travel to ensure compliance. Passengers who do not meet these requirements may be denied boarding by airlines, train and/or cruise lines and/or access to hotels and resorts. O-Creation Solutions LLC is not required and responsible to provide documentation and vaccination information.

Travel Protection 

  • Travel insurance is highly recommended to protect your investment from potential losses.

Travel insurance can be helpful should issues arise before or during your vacation: last-minute changes, lost luggage, delayed flights, hotel issues, medical emergencies, etc.

A slip and fall in hotel, resort or cruise ship or injury sustained on an excursion.

Travel protection will be offered to each client. It is the responsibility of each paying client to accept or decline travel insurance at the time of purchase or prior to travel.

Seat Selections on Flights

  • Seating selections are not guaranteed and are finalized by airline and is subject to change

Bedding at Hotels and Resorts

  • All requests for bedding preference are communicated to the staff of hotels and resorts; bedding requests are not guaranteed and based on availability at time of check in.

Release of Photos and Videos

  • O-Creation Solutions LLC may take photos or videos posted online to use for promotional or commercial use. Your reservation grants O-Creation Solutions LLC permission to do so without payment or any compensation.

International Travel

  • S. citizens traveling outside the United States and U.S. territories will need a valid U.S. passport.

U.S. Permanent Resident Card Holders

  • S. Permanent Resident Card Holders are responsible to contact the consulate for the country where they have citizenship for the requirements to travel to country, they wish to visit.

Vaccinations

  • The country you’re traveling to may require proof of vaccinations. Without proper vaccinations, you may be denied entry in the country. We recommend visiting http://wwwnc.cdc.gov/travel/to find information on health notices and recommended/required vaccinations for the countries you’ll be visiting.                                      

Covid-19 Waiver of Liability

  • All travelers ages 18 and older are required to read and sign Covid-19 waiver of liability at time of deposit for a reservation.                              

Visas

  • Some countries require visas to enter. Without a valid visa, you may be denied entry into the country. You can find out if you need a visa by visiting the embassy websiteof the country you’ll be traveling to.

Children Traveling with One Parent, or Someone Who is Not a Parent/Legal Guardian, or Children Traveling in a Group

  • Foreign border officials may require custody documents or written consent from the other parent/both parents. While the requirements may vary by country, here’s an example of what the US requires.

DISCLAIMER OF LIABILITY

This travel agency is acting as a mere agent for suppliers in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). This agency, therefore, shall not be responsible for breach of contract of any intentional or careless actions or omissions on part of such suppliers, which result in any loss, damage, delay, or injury to you or your travel companions or group members. Unless the term “guaranteed” is specifically stated in writing on your tickets, invoice, or reservation itinerary, we do not guarantee any of such suppliers’ rates, bookings, reservations, connections, scheduling, or handling of personal effects. Travel agent shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, world pandemics, disaster, Acts of Gods, local laws, climactic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent’s control. Traveler assumes complete and full responsibility for, and hereby releases the agent from any duty of, checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safely or security conditions at such destinations, during the length of the proposed travel. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department (202) 647­5225. For medical information, call the Public Health Service (404) 332-4559. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of such risks and is advised to obtain appropriate insurance coverage against them. Traveler’s retention of tickets, reservations, or bookings after issuance shall constitute a consent to the above, and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members.

Information We Collect
